These Terms of Service (“Terms”) apply to your use of the Mindful Maternity website, online courses, community, downloadable resources and associated services (together, the “Services”).

Please read these Terms carefully before purchasing or accessing the Services.

By purchasing, registering for or accessing Mindful Maternity, you agree to these Terms.

Mindful Maternity provides online antenatal education and birth preparation content, including information relating to hypnobirthing, pregnancy, labour, birth, birth preferences, maternity care, interventions and the early postnatal period.

2. Educational purposes only

All Mindful Maternity content is provided for general educational and informational purposes only.

The information provided through our courses, website, community, videos, downloadable resources and other materials is not medical advice and is not intended to provide medical diagnosis, treatment or individual clinical recommendations.

Nothing provided by Mindful Maternity should be used as a substitute for advice from your midwife, GP, obstetrician or other appropriately qualified healthcare professional.

Pregnancy, labour, birth and the postnatal period are individual experiences. Medical circumstances and appropriate recommendations can vary significantly from person to person.

You should always seek appropriate professional medical advice regarding your own pregnancy, health, symptoms, treatment and care.

If you have any concerns about your health, your pregnancy or your baby, you should contact an appropriate healthcare professional or maternity service promptly.

In an emergency, seek emergency medical assistance.

3. No guarantee of birth outcome

Mindful Maternity aims to provide knowledge, practical tools and birth-preparation techniques that can help you feel more informed and prepared for labour, birth and the early postnatal period.

However, birth is unpredictable and no particular birth experience or outcome can be guaranteed.

Purchasing, accessing or completing a Mindful Maternity course does not guarantee:

  • a particular type of birth;

  • a vaginal birth;

  • an unmedicated birth;

  • a pain-free birth;

  • a complication-free birth;

  • avoidance of induction;

  • avoidance of assisted birth, Caesarean birth or other medical intervention;

  • a particular length of labour;

  • a particular physical or psychological outcome; or

  • an experience corresponding with any testimonial, birth story or example featured by Mindful Maternity.

Our courses are intended to support education and preparation, not to predict or control how an individual pregnancy or birth will unfold.

4. Healthcare decisions

Mindful Maternity encourages you to understand your options, ask questions and participate in discussions concerning your maternity care.

However, our content does not tell you whether you personally should accept, decline or request any particular examination, monitoring, medication, treatment, procedure or medical intervention.

Any decision relating to your healthcare should take account of your individual circumstances and, where appropriate, be discussed with an appropriately qualified healthcare professional.

References within our content to research, statistics, guidelines, maternity practices, interventions or available options are provided for general educational purposes.

5. Course access

Unless otherwise stated at the point of purchase, purchasing a Mindful Maternity course provides the purchaser with personal access to that course for 12 months from the date of purchase.

Your access is personal to you and is for your own personal, non-commercial use.

Our online course, account and community platform is provided through Uscreen. You may therefore be required to create and maintain an account through the platform in order to access the Services.

You must not transfer, sell or share your account or routinely allow another person to access paid course content using your account.

We may update, improve, reorganise or replace parts of our courses during your access period, including where information, evidence or professional guidance changes.

Where reasonably possible, changes will not materially reduce the overall Service you purchased.

6. Account security and acceptable use

You are responsible for keeping your account, username, password and other login details secure and for taking reasonable steps to prevent unauthorised access.

You must not:

  • share your login details with another person;

  • allow another person to routinely access paid content using your account;

  • attempt to bypass account, payment or content security measures;

  • attempt to gain unauthorised access to another user’s account or restricted areas of the Services;

  • interfere with or attempt to disrupt the operation or security of the Services;

  • introduce malicious software, viruses or other harmful material;

  • scrape, harvest or systematically extract content or data from the Services without permission;

  • copy or distribute course materials without permission;

  • reproduce paid content for commercial purposes; or

  • use the Services for unlawful purposes.

We reserve the right to suspend or terminate access where we reasonably believe an account is being shared, misused or used in material breach of these Terms.

7. Prices and payment

The price payable for a course or other Service will be the price displayed at checkout at the time of purchase.

Any applicable taxes or additional charges will be displayed where required before you complete your purchase.

Payments may be processed by third-party payment providers. Those providers may process payment information in accordance with their own terms and privacy policies.

Where we offer different payment options, subscriptions or payment plans, the applicable price, billing frequency and other material terms will be displayed before you complete your purchase.

If you choose a recurring subscription or payment plan, you authorise the applicable payment provider to collect the payments shown at checkout using your selected payment method until the arrangement ends in accordance with the terms presented to you.

8. Digital content and cancellation rights

Mindful Maternity provides digital content which may become available immediately following purchase.

Under UK consumer law, consumers purchasing digital content online may ordinarily have a cancellation period.

However, where you expressly request that the supply of digital content begins during the cancellation period and acknowledge that beginning supply will result in the loss of your statutory right to cancel, your cancellation right may be lost once supply begins.

Where required by law, we will obtain your express consent and acknowledgement before providing immediate access to relevant digital content.

Nothing in these Terms affects your statutory consumer rights.

If digital content is faulty, not as described or otherwise fails to meet statutory requirements that cannot legally be excluded, you may have rights to a repair, replacement, price reduction, refund or other remedy as provided by applicable consumer law.

9. Refunds

Any additional voluntary refund policy offered by Mindful Maternity will be displayed at the point of purchase or on the relevant sales page.

Any voluntary refund policy operates in addition to, and does not replace or limit, your statutory consumer rights.

10. Intellectual property

Unless otherwise stated, all Mindful Maternity content and course materials are owned by or licensed to Mindful Maternity Ltd and are protected by applicable intellectual property laws.

This includes, without limitation:

  • course videos;

  • scripts and written material;

  • downloadable resources;

  • worksheets;

  • birth preference templates;

  • graphics and illustrations;

  • photographs;

  • audio recordings;

  • branding;

  • course structure; and

  • original website content.

Purchasing a course gives you a limited, personal, non-exclusive and non-transferable right to access and use the materials for your own personal, non-commercial purposes during the applicable access period.

You must not reproduce, record, copy, republish, upload, distribute, sell, licence, publicly display, commercially exploit or create substantially copied versions of Mindful Maternity materials without our prior written permission.

11. Community areas

Where Mindful Maternity provides community features, you are responsible for the content you choose to post.

We want our community to provide a welcoming and respectful environment. Healthy discussion and differences of opinion are permitted, but members must communicate respectfully.

You must not post content that is unlawful, threatening, abusive, harassing, discriminatory, deliberately misleading, defamatory or which infringes another person’s rights.

Spam, unauthorised advertising, excessive self-promotion and irrelevant promotional links are not permitted.

Community areas should not be used to provide medical diagnoses or to present personal medical opinions as professional medical advice.

Birth stories, opinions and personal experiences shared by community members represent those individuals’ experiences only. They should not be interpreted as medical advice or as evidence that another person will have the same experience or outcome.

You should take particular care when sharing personal, medical or sensitive information in community areas that may be visible to other members.

We reserve the right to moderate or remove content and, where reasonably necessary, restrict, suspend or terminate community access.

12. User-generated content

Where you submit comments, posts, birth stories, reviews or other material through the Services, you confirm that you have the right to submit that material and that doing so does not unlawfully infringe another person’s rights.

You remain responsible for the content you submit.

Submitting material to a community area does not transfer ownership of your original content to Mindful Maternity.

However, you grant us such limited rights as are reasonably necessary to host, display and make that content available through the relevant community feature.

We will not use an identifiable birth story, testimonial or other user submission in our external marketing merely because it has been posted within the community. Where appropriate, separate permission will be obtained for such use.

13. Testimonials and birth stories

Testimonials, reviews and birth stories featured by Mindful Maternity represent individual experiences.

Pregnancy and birth experiences vary considerably.

A testimonial or birth story should not be interpreted as a promise, representation or guarantee that another customer will experience the same or similar outcome.

14. Accuracy and changes in guidance

We take reasonable care when preparing our educational content and may refer to professional guidance, published research, statistics and maternity-care information.

However, healthcare guidance, evidence and clinical practice can change over time.

Information provided by Mindful Maternity is generally based on information available when the relevant content was prepared or last updated.

It should not replace current professional advice relevant to your individual circumstances.

We may amend or update course content where appropriate.

15. Advertising and representations

Mindful Maternity aims to describe its courses and Services accurately and responsibly.

Statements concerning the aims or potential benefits of our courses should be understood in the context of individual variation and do not constitute a guarantee of a particular birth, medical, psychological or health outcome.

Nothing in these Terms is intended to exclude responsibility for statements, representations or consumer rights where doing so would be unlawful.

16. Third-party platforms, websites and services

Our Services are delivered partly through third-party technology and service providers, including Uscreen and payment-processing providers.

Our website or courses may also contain links to third-party websites, resources, products or services. These may be provided for convenience or additional information.

Unless expressly stated otherwise, Mindful Maternity does not control independent third-party websites or services and is not responsible for their content, availability, security or privacy practices.

The inclusion of a third-party resource does not necessarily constitute an endorsement of every statement, product or service provided by that third party.

17. Availability of the Services

We aim to keep our Services available throughout your applicable access period but cannot guarantee uninterrupted access.

Temporary interruptions may occur because of maintenance, updates, technical problems, internet or hosting issues, third-party platform issues or circumstances outside our reasonable control.

Where a significant interruption within our reasonable control materially affects the Service you purchased, we will take reasonable steps to remedy the issue.

18. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability relating to statutory consumer rights that cannot legally be excluded or limited.

Subject to those rights, Mindful Maternity provides general educational content rather than personalised healthcare advice and is not responsible for a user’s decision to treat general educational information as individual medical advice.

You remain responsible for seeking appropriate professional advice regarding your individual pregnancy, health and maternity care.

Nothing in these Terms is intended to exclude or restrict any legal rights or remedies available to you as a consumer which cannot lawfully be excluded or restricted.

19. Privacy and personal information

We process personal information in accordance with applicable data protection law and our Privacy Policy.

Our Privacy Policy is available through the Mindful Maternity website and course platform.

20. Electronic communications

When you create an account or purchase a Service, we may send you electronic communications necessary to administer your account or purchase.

These may include purchase confirmations, receipts, account information, password or security communications, important Service information and changes affecting your access.

Marketing communications are dealt with separately in our Privacy Policy, and you may unsubscribe from marketing communications in accordance with that policy.

21. Changes to these Terms

We may update these Terms from time to time, including to reflect changes to our Services, technology, business operations or applicable law.

The current version will be published on our website or course platform and will display the date it was last updated.

Where required, we will take appropriate steps to inform existing customers of material changes affecting them.

Changes to these Terms will not retrospectively remove statutory rights or materially alter a completed purchase where doing so would be unlawful.

22. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom or another jurisdiction, you may also benefit from mandatory consumer protections that apply in the place where you live.

Nothing in these Terms deprives you of any mandatory rights or protections that cannot legally be excluded.

23. General

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

A failure or delay by Mindful Maternity to exercise a right under these Terms does not automatically constitute a waiver of that right.

Nothing in these Terms creates a partnership, employment relationship, joint venture or agency relationship between you and Mindful Maternity.
